# The Problem with ​“Fit”: Legal Risks and Best Practices

Partner [Mark Konkel](/Our-People/Mark-A-Konkel) authored the article, ​“The Problem with ​“Fit”: Legal Risks and Best Practices,” published in the *National Association of Legal Search Consultants* newsletter. The article discusses the legal risks in citing ​“fit” as a reason for rejecting a job candidate. Mark explains, ​“fit” is a vague term and plaintiffs can leverage that ambiguity by alleging that ​“fit” is actually signifying a form of employment discrimination like race or gender in a court complaint. Recruiters and employers potentially create a risk of an employment discrimination lawsuit when they use it.
