# TCPA Litigation: Key Issues and Considerations

Kelley Drye partners [Alysa Zeltzer Hutnik](/Our-People/Alysa-Z-Hutnik) and [Lauri A. Mazzuchetti](/Our-People/Lauri-A-Mazzuchetti) co-authored an article that appeared in *Thompson Reuters Practical Law*. In addition to reviewing the ruling by the Supreme Court defining automatic telephone dialing systems (ATDS) under the Telephone Consumer Protection Act of 1991 (TCPA), the article examines the key issues that counsel involved in TCPA litigation should consider, including rulemaking authority under the TCPA and the TCPA’s scope, enforcement powers under the TCPA, class action lawsuits, emerging TCPA-related issues, the potential for third-party liability, and best practices to minimize TCPA-related liability risks.
