# Litigation: Is Poker Gambling? One Decision May Answer that Question

The article reviews *U.S. v. DiCristina*, in which a federal jury convicted the defendant of operating an illegal gambling business but U.S. District Judge Jack B. Weinstein set aside the verdict, finding No-Limit Texas Hold ​‘em is not gambling because it is a game predominated by skill rather than chance. The authors analyze the opinion and what it means for the illegality of poker games in New York.
