# Déjà Vu – The NLRB Looks to Implement Prior Joint Employer Standard

The National Labor Relations Board (NLRB) has issued a notice of pro-posed rulemaking, seeking to replace the Trump-era final joint employer rule, which provided that an employer would be considered a joint employer under the National Labor Relations Act (NLRA) only where it exercised ​“substantial direct and immediate control” over the essential terms and conditions of another company’s employee.
