 Perry Austin focuses his practice on complex commercial litigation matters in federal and state courts. Perry has represented clients across a diverse range of industries—including financial services, healthcare, media, and professional services—in high-stakes disputes involving securities litigation, False Claims Act claims, defamation, trade-secret misappropriation, and other commercial matters.

Before joining Kelley Drye, Perry served on the internal legal team at a major international law firm. Perry began his career as an associate at a prominent litigation firm in Washington, D.C., where he represented clients in a wide range of complex civil disputes. He also served as oversight counsel on the United States Senate Committee on Health, Education, Labor, and Pensions.

Perry clerked for the Honorable Henry F. Floyd in the United States Court of Appeals for the Fourth Circuit and the Honorable John A. Gibney, Jr. in the United States District Court for the Eastern District of Virginia.

 

  Defended a global financial institution in residential mortgage-backed securities litigation in multiple state and federal courts.

Defended a pharmacy in False Claims Act litigation regarding prescriptions for patients in long-term care facilities.

Defended a specialty pharmacy in False Claims Act litigation related to shipping practices for refrigerated drugs.

Defended a national news media company in defamation litigation related to reporting on the COVID-19 pandemic, obtaining dismissal of all claims on First Amendment grounds.

Represented a national telecommunications company in a RICO action related to leases for wireless spectrum.

Represented an instant messaging and social platform as a third party in antitrust litigation against a major technology company.

Defended an Am Law 200 firm in litigation spanning multiple state trial and appellate courts.

Represented a veterans’ rights organization as amicus curiae in the U.S. Supreme Court.
