Sean discussed the practical realities of antitrust investigations, noting that while whistleblowers may hope the DOJ can build a case based solely on the information they provide, their involvement may ultimately be required. ​“I think when whistleblowers decide to come forward, they are resigned to the fact that it’s possible the division will need them and their identities might be outed,” Sean said. ​“But it’s something the DOJ would like to avoid at all costs.” Drawing on his experience as the former chief of the Antitrust Division’s New York office, Sean explained that the DOJ seeks to minimize the burden on whistleblowers whenever possible. He noted that requiring a whistleblower to testify before a grand jury can create significant pressure and may discourage future individuals from coming forward with information about potential antitrust violations.
