# Patent Law Institute Patent Blog Credits Kelley Drye For Filing First Lawsuit Against USPTO New Patent Rules

PLI’s Patent Blog cites Kelley Drye for being the first to file suit against the U.S. Patent and Trademark Office (USPTO) in regards to its new rules concerning the application for and continuation of patents. On behalf of Dr. Triantafyllos Tafas, Kelley Drye filed suit against the USPTO back in August 2007. Subsequently, Glaxo SmithKline Beecham filed a similar action which led the U.S. District Court for Eastern Virginia to issue a preliminary injunction temporarily restraining the USPTO’s new rules. In response to this patent decision, PLI’s Patent Blog thanks Dr. Tafas and Kelley Drye for the courage they first demonstrated by standing up to the USPTO.
