# Partner Wayne D’Angelo Quoted in *Environment and Energy Daily* Article on House Testimony

Partner [Wayne D’Angelo](https://www.kelleydrye.com/Our-People/Wayne-J-D-Angelo) was quoted in the *Environment and Energy Daily* article ​“NATURAL RESOURCES: Lawmakers trade barbs on migratory birds, water projects.” Wayne testified before the House Natural Resources subcommittee in early June, in relation to an amendment to the Migratory Bird Treaty Act to facilitate punishment of companies that accidentally kill protected birds.

Wayne argued on behalf of the oil and gas industry, with concern that the amendment to the bill was more than a mere clarification. He called it an expansion of the MBTA. One of his concerns, he said, was that ​“under the draft bill, incidental take becomes prohibited only if the activity causing the take is commercial in nature.” The conversation around these amendments is ongoing.
