# Metropolitan Corporate Counsel Highlights Kelley Drye Victory in Tafas v. USPTO

Kelley Drye & Warren was noted in the May 2008 issue of *Metropolitan Corporate Counsel* regarding the recent victory on behalf of firm client, Dr. Triantafyllos Tafas. On April 1, 2008, the U.S. District Court for the Eastern District of Virginia ruled that the U.S. Patent and Trademark Office’s (USPTO) new rules and claims were invalid because they involved substantive rule making beyond the scope of the agency’s authority. Kelley Drye filed a motion for summary judgment to stop the USPTO’s enactment of the highly controversial rules that would have imposed numerous arbitrary limitations on the number of continuations and claims per patent application.
