Partner Andrew Minkiewicz was quoted in the Law360 article “Seeing Loss Of Fishing Area, Anglers Try To Stop Wind Farm.” A coalition of fishing interests asked a Washington, D.C., federal court to halt a proposed lease sale for the potential development of a major wind farm off the coast of Long Island, New York, arguing that the process ignored major environmental concerns and would remove key areas from commercial fishing activity. The complaint’s lead plaintiff, the Fisheries Survival Fund, which represents a large number of Atlantic scallop fisherman, argued that the Bureau of Ocean Energy Management didn’t properly consider environmental concerns before scheduling a lease sale. The plaintiffs are represented by Mr. Minkiewicz, partner Dave Frulla, and senior associate Elizabeth Johnson. Mr. Minkiewicz noted that, “When you put 194 new turbines out there, that’s 194 new things to hit.” He went on to say that, “That is a fundamental change in the habitat,” noting that sediment clouds would harm scallops. New cables and turbine mounts, if they are needed, would also harm the existing environment.
