# Law360 Notes Pernod Loses ​“Havana Club” Case Against Bacardi

The *Law360* article ​“Bacardi’s Havana Club Brand Not Misleading: 3rd Circ.” reported an appellate court affirmed a district court’s ruling that Bacardi’s ​“Havana Club” brand does not falsely advertise Cuba as the rum’s place of origin as alleged by rival Pernod Ricard. The appellate opinion pointed out that the label on Bacardi’s Havana Club rum bottle clearly states that it is made in Puerto Rico. The article noted that **William R. Golden Jr.** of Kelley Drye represented Bacardi.
