Doty’s decision to grant Medtox’s motion for summary judgment and deny plaintiff Sandusky’s motion for summary judgment, in an action alleging violations of the Telephone Consumer Protection Act (TCPA). The judge found the settlement offer mooted Sandusky’s claim and further rejected Sandusky’s argument that Medtox’s promise not to send faxes is insufficient because it is not a court-ordered injunction, as demanded in the Complaint.
