# Lauri Mazzuchetti Quoted by *Law360* on TCPA Constitutionality Challenges and Fourth Circuit’s Government-Backed Debt Collection Call Decision

Partner [Lauri Mazzuchetti](/Our-People/Lauri-A-Mazzuchetti) was quoted in the *Law360* article ​“TCPA Constitutionality Fight Gains Steam with 4th Circ. Ruling.” The article discusses the Fourth Circuit’s unanimous decision in *AAPC, Inc. v. FCC* that a portion of the TCPA — one that exempted government-backed debt collection calls from the statute’s general prohibition on robocalls to cellphones — violates the First Amendment’s free speech clause. The ruling is expected to open the door to further TCPA litigation — and set up a possible split with with the Ninth Circuit, which is reviewing a similar dispute.

Lauri, appearing at a Federal Communications Bar Association seminar and quoted by *Law360*, called challenges to the constitutionality of the TCPA ​“a game changer,” but added that the Fourth Circuit’s ruling ​“was not a great decision for what is trying to be achieved across the board on that issue.”
