# Kelley Drye’s John Villafranco Featured in *FTCWatch*

The Supreme Court’s unanimous ruling in *AMG Capital Management LLC v. FTC* was the subject of a panel discussion during the ABA Spring Meeting, and a recent article in *FTCWatch*.

The high court ruled unanimously that the agency was improperly using Section 13(b) of the FTC Act to obtain retrospective relief. As a result, the agency has shown a willingness to adopt novel legal theories and bring cases that aren’t necessarily a ​“sure thing.”

“The FTC is more emboldened than I’ve ever seen,” said partner [John Villafranco](/Our-People/John-E-Villafranco). ​“Chair \[Lina\] Khan is litigating on principle and quite willing to take risks.”
