In an article in *Social Selling News* on the FTC initiating action on new earnings claims rule, partner [Donnelly McDowell ](/Our-People/Donnelly-L-McDowell)cautions that the Commission appears to be considering changes to the legal standard for earnings claims.

“The FTC previewed its position that ‘\[i\]n the Commission’s experience, we have not seen probative evidence that disclaimers effectively cure atypical earnings claims,” said Donnelly.
