# Kelley Drye Obtains Summary Judgment for Medjet

Kelley Drye Partners Joseph A. Boyle and Lauri A. Mazzuchetti of the New Jersey office prevailed on a motion for summary judgment in the U.S. District Court for the District of New Jersey on behalf of Medjet Inc. and two individual defendants. The action was brought against Medjet and other defendants by a state university claiming that several employees of the university were wrongfully omitted as named co-inventors, in violation of 35 U.S.C. § 256, on a patent owned by Medjet. The District Court issued an opinion granting the motion in its entirety, which quoted extensively from Kelley Drye’s oral argument. The summary judgment closed a major chapter in this litigation. Kelley Drye previously obtained summary judgment in New Jersey state court on a claim by the university that it had an ownership interest in the patent based upon the university’s patent policy. These intellectual property victories are major milestones in related litigations that began in 1998.
