# Intellectual Property LAWCAST Interviews Partner on Kelley Drye’s Winning Ruling that Voids USPTO New Rules

Partner was interviewed on *Intellectual Property LAWCAST* regarding Kelley Drye’s major legal victory in the *Tafas v. USPTO* case. Dr. Triantafyllos Tafas, represented by Kelley Drye, and GlaxoSmithkline Beecham, filed a lawsuit against the U.S. Patent and Trademark Office (USPTO) to stop the USPTO’s new patent rules from going into effect. The U.S. District Court for the Eastern District of Virginia ruled the new rules, which limited the number of patent claims and continuation applications that an applicant could file, are invalid. Judge James C. Cacheris granted the motion for summary judgment finding the USPTO rules were substantive in nature and exceeded the agency’s rulemaking authority.
