*ESIBytes* interviewed partner Mark L. Austrian for the podcast ​“Taxation of Electronic Discovery Costs, Recovering Processing Fees.” Vendor costs in e-discovery cases have risen dramatically in recent years, as typified by the Race Tires of America case in the 3rd Circuit in which a $300,000 bill for e-discovery costs was imposed. During the interview, Mr. Austrian outlines the argument for awarding costs to attempt to recoup processing fees, as well as the technical steps to preserve an argument for awarding costs in the event a decision is made to try and recover costs at the end of the case.
