Join Kelley Drye for an update on the rapidly evolving IEEPA tariff refund landscape — including the government’s appeal, CBP’s multi-phase refund rollout, the status of litigation over “final liquidated” entries, and the wave of consumer class action litigation now targeting importers and retailers nationwide.

Since our last webinar, the IEEPA tariff refund process has advanced significantly — but new legal risks have emerged alongside new recovery opportunities. CBP has authorized more than $128 billion in refunds and disbursed more than $100 billion to date. At the same time, the government has appealed the Court of International Trade’s universal refund order to the Federal Circuit, and over 80 consumer class actions have been filed against companies that passed tariff costs to customers.

Our team, including Partners [Jennifer McCadney](https://www.kelleydrye.com/people/jennifer-e-mccadney) and [James Saylor](https://www.kelleydrye.com/people/james-b-saylor), Special Counsel [Daniella Carelli](https://www.kelleydrye.com/people/daniella-carelli), and Senior Associate [Matthew Pereira](https://www.kelleydrye.com/people/matthew-g-pereira), will walk through:

- The government’s Federal Circuit appeal
- CAPE eligibility, refund status, and upcoming phases
- Options for recovery: CAPE, individual lawsuits, potential class action certifications
- Key commercial contract considerations including obligations to pass down all or a portion of refunds, treatment of interest, and practical protections to implement
- The consumer class action wave – assessing potential litigation exposure before claims arise.

This session will help companies understand where refunds stand today, assess litigation opportunities and risks on both the trade and consumer class action fronts, and position themselves to protect their interests as the legal landscape continues to shift.
