In December 2015, the Federal Communications Commission’s (FCC’s) Enforcement Bureau adopted a consent decree resolving the Enforcement Bureau’s investigation into whether the New York City Department of Education violated the competitive bidding rules of the FCC’s E-rate program. Under the terms of the consent decree, NYC DOE agreed to pay $3 million to resolve the dispute and to relinquish claims to much of its e-rate funding since 2002. This landmark settlement – the first handled by the FCC rather than the courts – will have implications for applicants and service providers alike.
