# Lessons Learned from the NYC E-rate Consent Decree

Special counsel Denise Smith will present ​“Lessons Learned from the NYC E-rate Consent Decree” during the 2016 SHLB Annual Conference. In December 2015, the Federal Communications Commission’s (FCC’s) Enforcement Bureau adopted a consent decree resolving the Enforcement Bureau’s investigation into whether the New York City Department of Education violated the competitive bidding rules of the FCC’s E-rate program. Under the terms of the consent decree, NYC DOE agreed to pay $3 million to resolve the dispute and to relinquish claims to much of its e-rate funding since 2002. This landmark settlement – the first handled by the FCC rather than the courts – will have implications for applicants and service providers alike.

This session will provide:

- An overview of the Compliance Plan measures adopted by the NYC DOE and what those mean for future enforcement cases
- Discussion of key FCC rules (competitive bidding procedures, gift limitations, etc.) under the E-rate program
- Suggestions on what service providers and applicants can do to protect themselves before, during and after USAC investigations
