Federal and state regulators, and the plaintiff’s bar, have prioritized privacy enforcement when it comes to health personal information. These laws and regulatory interpretations are new though, and businesses are still grappling with what constitutes health data, which laws apply, and what changes to make to their digital advertising and measurement practices. Industry is also evolving with a surge in retail media business models and different forms of data collaboration opportunities in which health and wellness-related advertising are important sources of revenue.
