On September 21, 2012, partner **Robert E. Crotty** spoke at the NJCCA’s 10th Annual Full Day CLE Conference. Mr. Crotty spoke on the session titled, ​“Drafting Arbitration Clauses: Strategies to Maximize Efficiency and Avoid Court Challenges.” This discussion gave an update on recent Supreme Court decisions concerning agreements to arbitrate, discussed why using ​“model” arbitration clauses or other cut-and-paste approaches can damage your position in a dispute, as well as how to evaluate, in both domestic and international circumstances, options such as venue, language, choice of law, pre-arbitration resolution, choosing arbitrators, procedural rules, preliminary relief, dispositive motions, discovery, sanctions and enforcement of awards.
