Kelley Drye attorneys are skilled at building and leading coalitions for both legislative and regulatory efforts.  We represent trade associations and longstanding coalitions, but have also been effective at building short-term strategic partnerships on specific issues ranging from the development of advanced renewable fuels to the impact of greenhouse gas regulations on energy-intensive, trade-exposed domestic industries.

Our team works with key environmental labor groups, academic institutions and think tanks who have strong voices on Capitol Hill and within administrations.  We work to identify and bring together groups who are knowledgeable in or have a stake in specific issues and have a track record of working with industry to develop commonsense solutions.

Our Government Relations and Public Policy practice group has deep knowledge of the energy industry, combined with strategic policy and legal insight.  Our bipartisan team represents a broad range of energy companies and associations on environmental, natural resources and federal land access issues, and our substantive experience is bolstered by our close collaboration with the firm’s regulatory practitioners.  Our government relations team has representative experience on behalf of both conventional and alternative energy producers and retailers, as well as energy consumers in a variety of industries.  From some of the world’s largest oil and gas companies to a coalition of start-up renewable energy producers, and from energy-intensive manufacturers to a high-tech producer of semiconductor solutions for energy efficiency, we have experience with a broad range of energy policy matters before Congress and the Executive Branch.

In addition to providing energy clients with strategic advice and advocating on their behalf, our team places a strong emphasis on the day-to-day monitoring of key policy issues before Congress.  We have strong relationships with Members and staff on key committees of jurisdiction, not only on energy and environmental issues, but also on relevant tax and trade, foreign affairs and natural resources matters.  We also represent energy clients before various federal agencies—including the Department of Energy, the Environmental Protection Agency, the Department of Commerce and the Department of the Interior—where decisions on the implementation, promulgation and enforcement of regulations can have an enormous impact on our energy clients’ businesses.   We have a proven ability to pursue a single objective through multiple arenas, using law, economics, government relations, public relations and grassroots advocacy to achieve client goals.  Whether helping energy companies evaluate the political and regulatory climate ahead of major investment decisions, ensuring them a seat at the table during important policymaking negotiations, helping to mollify the impacts of consequential rulemakings or assisting them in obtaining federal financial assistance for projects, our team provides guidance and advocacy support every step of the way.

  • Defended oil refinery clients in EPA enforcement actions alleging violations of NSPS, NESHAP and New Source Review regulations.

  • Coordinating environmental and permitting strategy and compliance in connection with FERC application for proposed LNG export facility.

  • Handled and resolved OSHA investigation surrounding fatality investigation of natural gas well fracking operations.

  • Challenged EPA’s authority to regulate GHGs under the Clean Air Act.

  • Successfully challenged on behalf of the oil and gas industry one of the largest critical habitat designations ever issued under the Endangered Species Act.

  • Led legal challenge of mandatory reporting rule for GHG emissions from upstream oil and gas operations.

  • Led challenge of BLM’s failure to issue oil and gas leases under the Mineral Leasing Act.

  • Led successful intervention of oil and gas lease sale that was challenged under NEPA for failure to adequately consider GHG impacts.

  • Challenged on behalf of the oil and gas industry, numerous FWS and NMFS listing proposals and decisions that adversely impact oil and gas operations (including listing proposals for the sperm whale, 66 species of coral, the lesser prairie chicken, the dusky shark and the dunes sagebrush lizard).

  • Successfully advocated for amendments to the Energy Independence Security Act (EISA) pertaining to renewable fuels and related EPA fuel waivers.
