  • Official Committee of Unsecured Creditors of Motors Liquidation Company f/k/a General Motors Corporation v. JPMorgan Chase Bank, N.A. (S.D. Bankruptcy Court, New York)
    We are representing JPMorgan Chase Bank in a lawsuit brought by the unsecured creditors’ committee in bankruptcy court in the Southern District of New York for the return of $1.4 billion in payments made by the estate of General Motors to the bank and other secured creditors of GM.

  • Dow Chemical Co. v. Reinhard and Kreinberg (E.D. Michigan)
    We represented JPMorgan Chase and senior executives in connection with litigation between Dow Chemical and its directors over an unauthorized leveraged buyout attempt.  Obtained dismissal of third-party complaint against JPMorgan.

  • JPMorgan Chase v. Liberty Mutual Insurance, et al. (S.D. New York)
    Trial counsel for JPMorgan Chase in a one-month jury trial in the Southern District of New York to recover over $1 billion from insurance companies that guaranteed structured finance transactions involving Enron.  Favorable settlement reached during jury deliberations.

  • Woodard v. Raymond James Financial Inc., et al. (S.D. New York)
    Represented Raymond James and certain of its officers and directors in class action securities fraud action seeking over $2 billion for the decline in value of RJF’s stock.  Obtained complete dismissal of action for RJF, officers and directors prior to start of discovery.

  • Syncora Guarantee, Inc. v. EMC Mortgage Corporation (S.D. New York)
    Represented EMC, a subsidiary of Bear Stearns, in federal securities litigation in which monoline insurers alleged fraud and breaches of warranties relating to the value of mortgage-backed securities, for which they had insured the interest and principal payments on part of a $666 million mortgage bond backed by home loans.

  • CFIP v. Citibank, N.A. (S.D. New York)
    Represented a former officer of Citibank, as corporate trustee, in dispute between investor and trustee over payments made in credit default swap.

  • Herron v. Fannie Mae (D.D.C.)
    Lead attorney in successfully defending Fannie Mae and executives against claims brought by an alleged whistle-blower; the court awarded all defendants summary judgment on all counts against them for wrongful termination, tortious interference with business expectancies and conspiracy.

  • Obtained a multimillion-dollar settlement under a fidelity bond for a financial institution receivership due to an international fraud committed by a former director.

  • Tried a complex letter of credit action brought in New York by a Swiss-owned U.S. company against an Indian bank.

  • Representing foreign banks and corporations as both plaintiffs and defendants in civil RICO and related federal bank fraud litigation.

  • Trial counsel to a leading financial institution in an eight-day bench trial in the Southern District of New York.  In a complete defense verdict, the judge dismissed a breach of contract and fraud suit brought against the client over its alleged failure to disclose potential tax liabilities when the plaintiff purchased one of the client’s lines of business.
