With every business relationship comes the risk of business dispute.  This is true locally within European Union Member States, and the complexity of contested matters only increases when they cross geographic and cultural borders.
Kelley Drye attorneys help prevent issues from arising and, in the event they do, we litigate disputes including corporate, contractual, tort law, employment and product liability before the EU and national courts.  The team has substantial experience dealing with cross-border litigation and with the coordination of legal procedures across the different EU jurisdictions, working as coordinating counsel where necessary.  We assist and represent our clients in proceedings before the European Court of Justice, the European Court of Human Rights and national courts.

EU Litigation

  • Represented the European Economic and Social Committee (EESC), an EU advisory body comprising representatives of workers’ and employers’ organizations and other interest groups, in a court procedure before the European Court of Justice.

  • Before the European Court of Justice, our lawyers launched the first court procedure ever against the European External Action Service, since it became an independent entity from the EU Commission in 2010.

  • Coordinated litigation procedures in several jurisdictions in the EU for a client with subsidiaries in several EU member states.  Where necessary, certain procedures were handled with the assistance of highly specialized local counsel.  The purpose of the coordination of the litigation was to streamline the implementation and interpretation of European law in all of these member states.

  • Represented a South American sovereign state in litigation procedures in Belgium.

  • Defended a U.S.-based major internet provider in criminal proceedings, including coordination with authorities in different countries regarding the exchange of information and the application of mutual legal assistance treaties.

  • Before Swedish courts, represented a client active in several EU member states in a case regarding the application of EU social security regulations.

U.S. Litigation for EU Companies

  • Represented a California subsidiary of a large German pharmaceutical company in the defense of separate lawsuits filed by the United States and Attorneys General from 27 states challenging pharmaceutical pricing practices.

  • Represented a large German construction conglomerate and its subsidiaries in a major U.S. litigation.  The U.S. Supreme Court confirmed a victory we secured when it denied certiorari of the case.

  • Represented a large Hamburg-based shipping company and obtained and enforced a $6 million judgment against the Government of Romania.

  • Prosecuted a breach of contract claim brought in Delaware by a German company against a U.S. chemical company.

  • Defended a German automobile manufacturer in class actions in California, New York and New Jersey.

  • Defended a German automobile manufacturer in litigation in Texas arising out of an airplane crash in Bangalore, India.
