Tiffany Arosemena is an associate in the firm’s Trademark and Copyright and Litigation practice groups.  Tiffany focuses her practice on prosecuting and defending trademark and copyright infringement, unfair competition, trade dress, publicity and privacy, and related commercial claims in federal and state courts.

She represents clients from a wide range of industries, including retail, fashion, entertainment and consumer products, working diligently to enforce their intellectual property rights both in the U.S. and abroad.

Tiffany has prior experience as a legal intern for Immigration Equality.

Steve Madden, Ltd. v. Jasmin Larian, LLC
Assisted in representing fashion company Cult Gaia in trade dress infringement action pending in Southern District of New York alleging that Steve Madden is promoting and selling bags that infringe the trade dress of client’s Ark bag.

Sterling Jewelers, Inc. v. Artistry Ltd.
Assisted in obtaining an affirmance in the Sixth Circuit Court of Appeals of a summary judgment dismissing all claims filed against client, Sterling Jewelers, Inc., the largest specialty jewelry retailer in the United States, in a declaratory judgment action in the U.S. District Court for the Northern District of Ohio seeking a judgment that Sterling’s ARTISTRY DIAMOND trademarks for the sale of jewelry at the retail level do not infringe common law trademark rights held by Artistry Ltd., a wholesale jewelry company.

Charisma World Wide Corp., S.A., v. Avon Products Inc.
Assisted in representing Avon Products in a trademark infringement and unfair competition dispute.  The matter settled favorably for the client.

Trademark Trial and Appeal Board

Gucci America, Inc. v. UGP, LLC
Obtained a judgment after trial in favor of client Gucci America, Inc., rejecting registration of trademark applications including the GUCCI mark by an alleged heir of the Gucci family.

IMG Worldwide LLC v. imediagroup, inc.
Assisted in representing IMG Worldwide in a TTAB opposition proceeding objecting to an applicant’s registration of the mark IMG in connection with marketing, advertising and other related services.  The matter settled favorably for the client after the commencement of discovery.

Copyright

Associate on team that defended a sports and entertainment representation firm in the Southern District of New York against claims of copyright infringement and breach of contract relating to a children’s television series featuring star quarterback Cam Newton.  Arbitration of claims raised initially in the Southern District of New York resulted in a complete victory for the client after a 5-day hearing and the lawsuit was dismissed.

Assisted in obtaining a dismissal in the Southern District of New York for a major fashion label in a case brought by three independent artists alleging copyright infringement and violations of the Digital Millennium Copyright Act claims.

Commercial Litigation

Associate on team that represented a world renowned actress’ trust against claims for breach of contract, conversion, accounting and breach of fiduciary duties dispute brought in New York State Court by an international auction house. The matter settled favorably for the client after the commencement of discovery in the New York Appellate Division.

Assisting in the representation of an international contractor and managing expert and fact witnesses in complex international arbitration proceedings related to a cutting edge renewable energy project.

Assisting in the representation of an infant nutrition company in a lawsuit filed by the FTC alleging that infant formula advertising claims violated Section 5 of the Federal Trade Commission Act, as well as six “piggy back” class actions alleging breach of warranty, intentional and negligent misrepresentation, unjust enrichment, and violation of various state consumer fraud and false advertising statutes.

Assisting in the representation of clients in actions brought pursuant to the Telephone Consumer Protection Act (TCPA).

Assists with managing, enforcing and providing strategic advice for famous European fashion houses regarding each company’s U.S. trademark and copyright portfolios.

Assists with managing and providing strategic advice regarding a worldwide trademark and copyright portfolio for a famous international entertainment enterprise, including trademark, maintenance and the enforcement of trademark registrations in over 80 countries worldwide.

Assists with advising and representing an international athletic apparel and footwear retailer regarding the maintenance and enforcement of intellectual property.
