Steve Caley represents middle-market and Fortune 500 companies in commercial and business litigation at the trial court and appellate levels.  His experience includes litigation pertaining to complex contract, business tort and statutory disputes; false advertising and deceptive trade practices; corporate trust claims; bankruptcy litigation; and complex toxic tort defense.  He also defends law firms and lawyers against legal malpractice and similar claims.

Steve navigates his clients through high-stakes commercial litigation matters, bringing to bear the commitment, focus, ingenuity and efficiency needed to revolve their disputes.  Having worked on hundreds of disputes over the course of his career, Steve’s hands-on experience in courtrooms in New York and elsewhere, as well as his sound judgment, aid him in obtaining favorable results for his clients.

Although Steve is a highly effective trial and appellate counselor, he knows from first-hand experience that not all disputes should be tried in court.  Accordingly, Steve has a proven track record of using dispute resolution options such as mediation and the like when it serves his client’s interests to do so.  Notably, however, Steve has also successfully taken complicated cases to trial and through the appeals process.  He works diligently with each client to identify the critical elements of a dispute that will be presented and scrutinized in court.

Having both prosecuted and defended multimillion-dollar cases over decades of practice, Steve is experienced and knowledgeable regarding every phase of the dispute resolution process.  Always prepared, Steve organizes and presents facts and legal arguments in succinct but thorough written and oral communications that allow him to advocate his client’s position clearly and effectively.  Steve’s straightforward communication style and calm but firm manner are appreciated by clients and in the courtroom.

Serves as settlement special master for the New York Appellate Division, First Department.

Commercial and Financial Litigation

Represented JPMorgan Chase Bank in a lawsuit against 11 insurance companies seeking the recovery of more than $1 billion under surety bonds supporting certain commodity sales transactions involving Enron.  The case settled after four weeks of trial.

Defended an engineering company against multimillion-dollar contract and business tort claims.  Obtained a jury verdict at trial, which was affirmed on appeal. 

Represented a major private bank in the successful appeal of a district court order that had required the bank to arbitrate third-party claims against it.  The Court of Appeals vacated the district court’s order and remanded with instructions to dismiss the case for lack of personal jurisdiction over the bank.

Represented a major bank against multimillion-dollar claims alleging breaches of duty as indenture trustee.  The case settled on eve of trial.

Lanham Act and False Advertising

Represented a major producer and marketer of fruit juices in litigation involving false advertising and unfair competition claims.  The client obtained a jury verdict at trial.

Represented a major technology company in a lawsuit brought by a state attorney general alleging fraudulent and deceptive trade practices with respect to advertising, warranties, rebates, technical support and customer service.  The case settled.

Represented a television production company in a Lanham Act/trademark infringement case in the United States District Court for the District of Arizona.  The court granted our motion for preliminary injunction, following which, the case settled.

Represented a major bus line in Lanham Act false advertising litigation in the United States District Court for the Southern District of New York.  Obtained a TRO, temporarily enjoining advertising by a competitor, after which the case settled.

Briefed and argued an appeal to the Second Circuit Court of Appeals in a false advertising case brought by the FTC against a marketer of weight loss products.

Represented an internet marketing company against deceptive trade practices litigation brought against it in state court by the New York State Attorney General.  The AG sought millions of dollars in disgorgement, but the court awarded only $3,746.

Legal Malpractice

Represented a major law firm against a legal malpractice complaint by bondholders alleging tens of millions of dollars in damages.  Successfully moved to dismiss the complaint, and the dismissal was affirmed on appeal.

Represented a major law firm in a multimillion-dollar case alleging malpractice in connection with trusts and estates work by the firm.  Successfully moved for summary judgment dismissing all claims against the firm and its attorneys.

Bankruptcy

Represented JPMorgan Chase in multibillion-dollar adversary proceedings brought by Enron in its Chapter 11 case. The matter was settled.

Represented a major reprographics company in an appeal of a multimillion-dollar bankruptcy court judgment.  The case settled.

Represented a major manufacturer of pulp and paper equipment against common law and bankruptcy claims brought by a Chapter 7 trustee.  The case settled.

Product Liability and Toxic Torts

Represented a manufacturer of Agent Orange in a lengthy, complex MDL litigation encompassing numerous actions alleging injuries caused by exposure to Agent Orange during the Vietnam War.  The original veterans’ class action settled; opt-outs and other later claims were dismissed on summary judgment.

Labor and Employment

Represented a major health insurance company in an age discrimination case that settled in midst of trial.

Represented a major manufacturing company in a wrongful discharge suit, obtaining summary judgment dismissing the action.

Advised a major law firm with respect to an age discrimination case brought by the EEOC.  The case settled.

Trusts and Estates Litigation

Represented a large estate in a contested probate proceeding related to a high-profile attempted murder prosecution.  The case settled.

Represented an estate beneficiary against efforts by relatives of the testator to undo probate of the will.  The case settled in the midst of trial.

Represented a major bank as trustee in a contested trust accounting, which settled.

Environmental

Represented a major refining and marketing company in an underground gasoline storage tank leakage case.  Obtained summary judgment for the company, which was affirmed on appeal.

Represented a major manufacturing company in an environmental recovery action against prior owners of the property.  The case settled.
