Michael Yim’s employment law practice is international in scope and includes executive employment strategies such as noncompetition, trade secrets and cross-border mobility and compensation, as well as discrimination, whistleblower and other labor-related matters.  Notably, Michael offers extensive skill in resolving complex wage and hour claims, including class actions with millions of dollars in dispute.  He has served as lead counsel in dozens of high stakes matters, and works diligently with each client to develop comprehensive strategies for all workplace issues.

Prior to joining Kelly Drye, Michael served as a partner at an AmLaw 200 law firm, as well as at a national labor and employment law boutique.

Successfully defended a leading equine veterinarian in AAA arbitration, resulting in the striking down of the scope of a client-based restrictive covenant from over 3,000 clients down to less than 10.

Successfully obtained a full dismissal of sexual harassment claims against a healthcare staffing company in an administrative charge.

Formulated trade secrets and noncompetition policies and agreements for various clients.

Advised a hedge fund manager in negotiations involving LLC membership admission, restructuring of management and employment terms.

Successfully represented an international financial institution in defending claims for benefits from a former member of its board of directors.

Defended restaurants and other businesses in various overtime, tip credit, minimum wage and wage deduction lawsuits.

Counseled a bank in pre-litigation risk management strategies related to employee benefit programs.

Counseled a Korean conglomerate on labor and employment issues arising out of its acquisition of a California-based healthcare company.

Represented various executives, professionals and other white collar employees in claims for unpaid wages, benefits and indemnification.

Successfully defeated an attempt by a probate estate to obtain ERISA trust fund assets for use in a decedent’s estate to satisfy personal debts.
