Kimberly Carter is special counsel in Kelley Drye’s Litigation and Labor and Employment practices and is located in the firm’s Los Angeles office.

Kimberly’s practice focuses on a wide array of employment law matters including defense of high-stakes single plaintiff litigation, wage and hour class action and compliance counseling.  She has extensive experience defending employers against claims of wage and hour violations, discrimination, harassment and retaliation, invasion of privacy, wrongful termination and other employment-related torts and liabilities brought under Title VII of the Civil Rights Act of 1964, the ADA, the FMLA and other state and federal laws.

Kimberly also regularly counsels clients on employment-related issues ranging from disability accommodations, protected leaves of absence, personnel policies, employee handbooks, and employee discipline and termination.
 
Represented large international industrial materials company against claims of national origin discrimination, harassment, retaliation and wrongful termination.

Defended major hardware and furniture manufacturer against claims of disability discrimination and wrongful termination.

Represented major logistics and transportation services company in large class action lawsuit alleging numerous wage and hour violations.

Assisted international industrial materials company in drafting employee and HR handbooks, with particular attention to policies and procedures regarding classification of exempt and non-exempt employees, prohibiting unlawful harassment, Family and Medical Leave Act policies, and disciplinary procedure policies.

Prepared domestic and international wage and hour law surveys for major luxury brand and retailer.

Counseled large digital entertainment company on various employment-related issues in order to minimize its exposure to employment litigation.

Defended major food supplier against California Labor Code Section 132a claims brought by former employees before the Worker’s Compensation Appeals Board.
