Katie Townley is an associate in the firm’s Washington, D.C. office. Her practice focuses on advertising and marketing, privacy and information security, product safety, and other consumer protection law matters.
Katie drafts privacy policies to address current and future information collection and use and advises clients on compliance with federal and state privacy and data security laws. She also assists clients with the development and implementation of social media platforms and programs, as well mobile apps and games, that comply with consumer protection and privacy laws.
In the area of information security, Katie evaluates clients’ compliance with federal, state, and PCI requirements relating to the storage, transfer, sharing, and disposal of customer personal information. She also drafts information security provisions for contracts with service providers and has experience drafting data security breach incident response plans to help businesses navigate their obligations under state data breach notification statutes in the event of a breach.
In addition, Katie provides advice to retailers on compliance with federal and state privacy laws addressing information collection at the point-of-sale, both online and in retail stores, such as California’s Song-Beverly Act, as well as the collection and use of consumer information obtained through social media, mobile applications, sweepstakes and contests, and the use of tracking technologies.
Katie also reviews advertisements and marketing materials for all media to determine compliance with relevant laws and ensure that claims are properly substantiated, and assists clients in the development and structuring of national and international promotions, including by drafting official rules and prize provider agreements and reviewing ad copy. She also has particular experience regarding compliance with the FTC’s apparel labeling requirements, including the Textile Act, Wool Act, Fur Products Labeling Act, Care Labeling Rule, and “Made in U.S.A.” enforcement policy statement.
Previously, Katie served as an intern in the U.S. District Court for the District of Massachusetts for the Honorable Richard G. Stearns.
Contributor to the "Private Advertising Litigation (PAL) Recent Litigation Developments" – an online publication by the American Bar Association’s Private Advertising Litigation Committee that summarizes the latest cases that shape advertising law.
Counsels a national computer hardware retailer on compliance with state service contract provider statutes, including applicable registration obligations.
Assists clients in developing and auditing telemarketing compliance programs under the TCPA, TSR, and state laws.
Reviewed the retail pricing policies of several national retailers for compliance with state and federal promotional pricing laws and precedent set by recent court decisions involving promotional pricing at retail and outlet stores.
Reviewed shelf and ad tags for compliance with state promotional pricing and weights and measures statutes for a national retail drug chain.
Evaluated an activewear manufacturer and distributor’s compliance with CPSC testing and certification requirements.
Assisted a client evaluate and comply with its data breach notification requirements, including responding to follow-up from several state Attorneys General’s offices.
