Fabio Dworschak’s practice focuses on environmental and commercial disputes and appeals in state and federal courts. Fabio has represented public and private clients in a diverse array of disputes, including actions arising from the Clean Water Act (CWA), Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), Telephone Consumer Protection Act (TCPA), Federal Employers Liability Act (FELA), breach of contract, and business and environmental torts.

Fabio also advises regulated companies and industries on environmental and natural resources matters.  Fabio has advised clients on regulatory issues arising from the Clean Air Act (CAA), CWA, National Environmental Policy Act (NEPA), Resource Conservation and Recovery Act (RCRA), Toxic Substances Control Act (TSCA), and tribal law.

Fabio began his legal career as a law clerk for the Honorable Rolando Olvera in the Southern District of Texas. While in law school, he served as an intern in the Washington State Supreme Court and King County Superior Court and on the Student Bar Association.  Before law school, Fabio served as an Army medic during deployments to Afghanistan and Iraq, earning the Combat Medic Badge in Iraq for medical services rendered while under hostile fire.

Fabio continues to serve others by maintaining an active pro bono caseload.

Environmental Litigation Experience

Representing the State of North Carolina in bringing statutory and common law claims against DuPont and Chemours for GenX contamination from their Fayetteville, North Carolina plant across a broad swath of the Cape Fear River and Coastal North Carolina.

Representing the Attorneys General of the Commonwealth of the Northern Mariana Islands and Guam in actions related to territory-wide PFAS contamination.

Representing numerous CERCLA potentially responsible parties and defendants against contribution claims in contaminated oil recovery site.

Business, Commercial, and General Litigation Experience

Representing railroad company in breach of contract and warranty action arising from purchase of locomotive fleet.

Representing mortgage company in a multi-million dollar dispute over the acquisition of real property in Texas.

Representing clients in putative class actions and individual claims in state and federal court alleging violations of the TCPA.

Representing national company in negligence lawsuit, resulting in a bench trial victory via a motion for directed verdict.

Representing clients in FELA, personal injury, and negligence lawsuits.

Appellate Experience

Representing the Attorney General of Guam in the United States Court of Appeals for the District of Columbia and the United States Supreme Court in a CERCLA action against the United States to recover the costs of removal and remedial actions incurred by Guam due to military contamination and operations on the island for decades.
 

Pro Bono

Graustark Members II, LLC v. Minor, No. 01-19-647-CV (Tex. App.—Houston [1st. Dist.] 2020, no pet.).  Representing tenant in a landlord-tenant dispute based on the Texas Property Code, resulting in successful ruling in client’s favor.

Aaron Booth v. Galveston County, No. 19-40785 (5th Circuit). Representing three public interest non-profits in amicus brief supporting the Sixth Amendment right to an attorney at an initial bail determination hearing.

Representing seller in a breach of contract arising from the sale of real property in Houston, Texas.

Representing veterans and other Houstonians in expunging their records or preparing their wills.

Representing asylum seekers and other migrants before the Board of Immigration Appeals.
