Elisa Nemiroff is a senior associate in the firm's Washington, D.C. office. Her practice focuses on counseling clients regarding all elements of advertising and promoting their brands, products, and services across all media. She works closely with clients to evaluate both the legal and business considerations of domestic and international advertising campaigns and to ensure these campaigns comply with laws.

Elisa provides advice to a wide variety of companies, such as manufacturers of foods, beverages, and dietary supplements, including leading companies in the distilled spirits and quick service restaurant industries, as well as a major gasoline marketer, direct marketers, retailers, Internet service providers and other consumer products companies.

Lead associate representing and assisting an international distilled spirits manufacturer, international quick service restaurant, major multi-national gasoline marketer, and a dietary supplement manufacturer across all aspects of their advertising and promotional needs.

Counseling clients regarding regulations, statutes and policies enforced by the Federal Trade Commission and state Attorneys General.

Reviewing and evaluating advertisements and marketing materials for all media, including television, print, Internet, social media, direct mail and telephone, to determine compliance with relevant regulations and the risk of challenge from regulators, competitors, or consumers.

Assisting clients in developing targeted advertising campaigns against competitors.

Assisting clients in developing loyalty and reward programs to promote their brands.

Assessing claim substantiation for product performance and competitive claims.

Managing national and international taste tests, preference tests, and other consumer surveys in support of advertising claims and providing related legal counseling.

Drafting and negotiating agency, sponsorship, licensing, consulting, promotion, endorsement, and influencer agreements.

Challenging competitors' and defending clients' advertising before the National Advertising Division and National Advertising Review Council of the Council of Better Business Bureaus.
