David Lindenbaum is committed to helping businesses and individuals safeguard their valuable IP assets at all stages of development.  He is dedicated to designing multifaceted IP strategies that align with each client’s specific commercial objectives.

In addition to prosecuting patent and trademark applications before the U.S. Patent and Trademark Office (USPTO), David also litigates patent, trademark, and false advertising disputes in federal district and appellate courts and before the Patent Trial and Appeal Board (PTAB).  David also authors opinions related to patent validity and infringement, and serves as lead counsel for patent license negotiations on behalf of domestic and international corporations.

David’s experience spans a variety of technical fields, including medical devices, semiconductors, pharmaceuticals, telecommunications, automotive systems, computer software, consumer electronic devices, manufacturing equipment and financial services.  David’s industry-specific know-how not only allows him to tailor his advice to each client’s business, but also to leverage his clients’ strengths in order to gain and fortify their competitive advantage.
 
Successfully defended a patent directed to fuel-systems in an instituted IPR filed by a major automobile manufacturer (PTAB).

Representing the owner of a patent portfolio directed to insurance claim processing systems in multiple patent infringement suits and concurrent CBM proceedings before the PTAB.

Representing an international confectioner in a trademark infringement and breach of contract suit (E.D.N.Y.).  Secured a favorable summary judgment ruling on all liability issues.

Won a Lanham Act trial for a pharmaceutical company, including injunctive relief and multimillion-dollar damages award (D.N.J.).

Secured affirmance of a jury verdict of invalidity for a prominent health and beauty aids manufacturer in a patent infringement suit directed to sanitizing lotions (D. Del., Fed. Cir.).

Defended a major semiconductor chip manufacturer in a multimillion-dollar patent infringement suit that settled favorably during trial (E.D. Tex.).

Secured a dismissal with prejudice before significant discovery in a suit filed by a nonpracticing entity asserting a patent directed to the presentation of substitute products to web users at checkout (D. Del.).

Obtained a settlement and dismissal on terms favorable to the leading manufacturer of grilling products in a patent infringement suit involving wireless thermometer technology (D.N.J.).

Represented a declaratory judgment defendant in a suit directed to microprocessor chip assemblies that settled favorably prior to trial (N.D. Cal.).

Represented a manufacturer of radar-level measuring devices in a patent infringement suit that settled favorably prior to trial (E.D. Tex.).

Represented the plaintiff in a patent infringement suit directed to the medical treatment of choroidal neovasculature (D. Mass.).

Represented an automobile manufacturer in a suit directed to injection molding methods that settled favorably prior to trial (N.D. Cal.).

Represented an international retailer in multidistrict patent infringement litigation directed to mouse-over website functionality.  The lawsuit was stayed pending reexamination.
