Caitlin Hickey focuses her practice on complex commercial litigation, with an emphasis on class action suits. Caitlin has a demonstrated history of working on cases in areas of false advertising, TCPA claims, and violation of consumer protection statutes.

Caitlin also provides pro bono services, specifically in asylum cases and post-trial criminal defense.

Prior to joining Kelley Drye, Caitlin was a legal intern in Fordham Law’s Criminal Defense Clinic, working with indigent clients in Manhattan state court.

Defended website owner/operators against putative class action claims asserting privacy violations under state wiretapping statutes.

Currently defending a dietary supplement company in an enforcement action brought by the Federal Trade Commission and the New York Attorney General’s office.

Representing clients in all stages of litigation through trial in private and governmental actions brought pursuant to the Telephone Consumer Protection Act (TCPA) and Telemarketing Sales Rule.

Obtained dismissal of petition for pre-litigation discovery into policy records for life insurance policy. Caitlin presented oral argument in opposition to the request.

Obtained dismissal at motion to dismiss stage on purported assignee’s claim for policy proceeds for $1.5 million life insurance policy. The decision was affirmed on a motion for renewal and/or re-argument.

Obtained a summary judgment dismissal of RICO claim alleging that national life insurance company conspired with promoters and insurance brokers in connection with the sale of insurance policies to be used as investment vehicles for employer welfare benefits plan under Section 419 of the tax code.

Pro Bono

Caitlin has worked on several pro bono matters, including representing people who are incarcerated, asylum seekers, and individuals seeking 17-A guardianship.

Obtained an order of guardianship for the mother of an adult child with a rare genetic neurological and developmental disorder that made the child incapable of performing even the activities of daily living without her mother’s assistance.

Represented a Senegalese woman seeking asylum because of lifelong violence against her due to her sexual orientation. Filed a writ of mandamus arguing the government’s failure to timely schedule an asylum interview violated the Administrative Procedure Act and represented the client in her subsequent asylum interview. The client was granted asylum a week after her interview.

Caitlin has volunteered at The Kite, Horizons Juvenile Detention Center and at the WomensLaw, Hotline.
