Annie Mitchell is special counsel in the litigation practice.  Her practice focuses on representing corporate clients in commercial litigation, bankruptcy litigation, government investigations, and white collar defense.  She regularly serves as both plaintiffs and defense counsel in a variety of litigation matters in federal and state courts, including breach of contract, financial services, false advertising, environmental and mass torts, and copyright and trademark infringement matters.  She also represents creditors and indenture trustees in adversary proceedings and contested matters in bankruptcy litigation.  In her white collar practice, she frequently guides and advises clients through internal and government investigations relating to potential violations of federal criminal laws and the False Claims Act.

Defended bio-energy company against environmental and mass tort claims arising out of former operations.

Assisted in representation of multi-national company in parallel civil-criminal fraud investigations by DOJ.

Assisted in representation of official committee of unsecured creditors in contested matter regarding bankruptcy plan.

Assisted in representation of individual in connection with SDNY criminal prosecution.

Represented indenture trustee in contested matter concerning DIP financing orders in ancillary bankruptcy action.

Assisted in the representation of JPMorgan Chase Bank in lawsuit brought by the unsecured creditors’ committee in bankruptcy court in the Southern District of New York for the return of $1.4 billion in payments made by the estate of General Motors to the bank and other secured creditors of GM.

Member of litigation team that represented a national testing laboratory in licensing dispute concerning the sale of genetic testing kits that can predict the effectiveness of certain types of cancer treatments.  At the conclusion of extensive discovery the case was settled on confidential terms.

Member of trial team representing a leading Indian international information technology company against claims under the California False Claims Act through summary judgment and trial preparation and resulting in a favorable settlement before trial.

Lead appellate counsel representing municipal entity against employment discrimination claims on appeal to the First Department of the Supreme Court of the State of New York, Appellate Division, including oral argument, and resulting in a favorable and unanimous decision.

Member of litigation team representing a life insurance company and obtaining pre-discovery summary judgment on a claim for negligent underwriting.

Lead associate on trial team that obtained a favorable outcome in the defense of an action to enforce a forged multi-million dollar promissory note.

Lead associate on successful appeal to U.S. Court of Appeals for the Fifth Circuit and obtaining reversal of multi-million dollar jury award for breach of contract and unjust enrichment claims.
