ANNE-MARIE MITCHELL Senior Associate
Annie Mitchell is a senior associate in the litigation practice with experience in commercial and complex civil litigations, government investigations, and white collar defense.  Her practice focuses on representing corporate clients in all aspects of litigation, including government investigations relating to potential violations of federal criminal law, and the defense of false claims act, consumer class actions, environmental and mass torts, copyright and trademark infringement, and products liability lawsuits.  Annie has significant experience in efficiently managing all phases of litigation and investigations including conducting discovery and depositions, appearing in court and arguing motions, preparing for trial and navigating appeals.  She also frequently assists clients in mediations and in negotiating favorable settlements and outcomes.
 

Professional Activities

Annie is a managing editor and occasional author of the ABA Young Lawyer Division’s publication, The Young Lawyer.  She is also an active member of The New York Foundling’s Junior Board.
 
Assisting in the representation of JPMorgan Chase Bank in lawsuit brought by the unsecured creditors’ committee in bankruptcy court in the Southern District of New York for the return of $1.4 billion in payments made by the estate of General Motors to the bank and other secured creditors of GM.

Member of litigation team that represented a national testing laboratory in licensing dispute concerning the sale of genetic testing kits that can predict the effectiveness of certain types of cancer treatments.  At the conclusion of extensive discovery the case was settled on confidential terms.

Member of trial team representing a leading Indian international information technology company against claims under the California False Claims Act through summary judgment and trial preparation and resulting in a favorable settlement before trial.

Lead appellate counsel representing municipal entity against employment discrimination claims on appeal to the First Department of the Supreme Court of the State of New York, Appellate Division, including oral argument, and resulting in a favorable and unanimous decision.

Member of litigation team representing a life insurance company and obtaining pre-discovery summary judgment on a claim for negligent underwriting.

Lead associate on trial team that obtained a favorable outcome in the defense of an action to enforce a forged multi-million dollar promissory note.

Lead associate on successful appeal to U.S. Court of Appeals for the Fifth Circuit and obtaining reversal of multi-million dollar jury award for breach of contract and unjust enrichment claims.

Lead associate in litigation team that obtained a pre-discovery dismissal of an action against a financial institution for the alleged wrongful backup withholding of investment income tax.
