DC Circuit Upholds FCC Invalidation of Verizon Winback Program

On Tuesday, February 10, the U.S. Court of Appeals for the DC Circuit upheld the Federal Communications Commission’s June 2008 ruling against Verizon’s retention marketing program” that used number porting requests from other carriers to target winback efforts. Rejecting all of Verizon’s arguments, the DC Circuit Court concluded that Verizon violated Section 222(b) of the Communications Act of 1934.

The Communications practice group has prepared a client advisory discussing the DC Circuit Court ruling. The decision has potentially important implications for how all telecommunications carriers handle number porting requests.
