authored, “Chapter 13: Enforcement of Forum Selection Clauses,” in the seminal treatise, Commercial Litigation in New York State Courts, Fourth Edition
. The chapter provides a general overview of forum selection clauses, an important contractual tool found in almost every type of contract. These clauses designate, by mutual agreement, a specific state’s forum for litigation and sometimes a particular court in that state. Rob also examines commonly litigated issues that arise when parties attempt to enforce a forum selection clause and the recent trends in the enforcement of forum selection clauses.
Rob gratefully acknowledges senior associate Sojin Yoon’s substantial assistance in the preparation of the chapter.
