Partners Andy White and August Horvath authored the InsideCounsel article “The New High-Profile Antitrust Claims in Media & Entertainment to Know.” The article discusses recent antitrust investigations regarding two different types of anti-competitive practices in the media and entertainment industries. In the past few years, the Department of Justice initiated a lawsuit against Apple and five large publishing houses concerning allegations of e-book price fixing violating Section 1 of the Sherman Act. The Department of Justice also launched a lawsuit against prominent Silicon Valley companies accusing the defendants of preventing employee movement and suppressing and fixing wages for skilled labor. These cases demonstrate increasing antitrust scrutiny as entertainment and media companies grow in a tech dominated age.
