Importers Beware: US Customs In Enforcement Mode

Special counsel Laura Rabinowitz authored the Law360 article “Importers Beware: US Customs In Enforcement Mode.” The article discusses the U.S. Customs and Border Protection enhancing enforcement and increasing its trade prosecution, as mandated by the Trade Facilitation and Trade Enforcement Act of 2015. As a result of the Act, Customs has been sending out letters to large importers advising them to conduct internal compliance reviews, monitor their reported entry data and reminding them of their responsibility to “exercise reasonable care” with relevant laws and regulations. These letters are the first time Customs has forthrightly advised importers to do compliance reviews, file prior disclosures and “correct the issues and submit loss of revenue.”
