This article examines whether copyright defendants are and should be entitled to attorney fees after voluntary dismissal either as prevailing parties under the Copyright Act in the wake of the U.S. Supreme Court case Buckhannon Board & Care Home, Inc. v. West Virginia Department of Health & Human Resources and related cases, or under other authority.
