Diplomatic Immunities and the Individual’s Right of Access to a Court

Special counsel Frédéric Dopagne published “Immunités des représentants diplomatiques et droit d’accès au juge“ in the Belgian Journal des tribunaux (2017, at p. 352). This case note is about the October 28, 2016 judgment of the Belgian Supreme Court upholding the immunity from civil jurisdiction of a diplomatic agent accredited to NATO in a rental dispute, notwithstanding the plaintiff’s argument that immunity contravenes the individual’s right of access to a court guaranteed under the European Convention on Human Rights.
