Kelley Drye Successfully Represents Life Fitness In Products Liability Case

Kelley Drye won a jury verdict after a 14-day trial for Life Fitness, a division of Brunswick Corp., in a products liability case in the Circuit Court of Cook County, Illinois. Life Fitness is a leading producer of commercial and home fitness equipment. The plaintiff claimed she had been injured while using a treadmill manufactured by Life Fitness. The court agreed with Kelley Drye that the plaintiff could neither establish product defect, nor justify that the treadmill was unreasonably dangerous. Kelley Drye also successfully argued that the plaintiff failed to utilize available safety features and training on the proper use of the treadmill and hence assumed the risks involved.
