Kelley Drye Secures Victory for Western Wireless

Kelley Drye scored a win on behalf of client Western Wireless Corporation with a decision in the U.S. District Court for Montana granting Western Wireless’s Motion to Dismiss against Qwest Corporation. Qwest had filed a third-party claim against Western Wireless in an attempt to drag the company back into a suit from which Western Wireless had already been dismissed after settlement with plaintiff Mid-Rivers Telephone Cooperative. The Court agreed with Kelley Drye that Qwest failed to provide the Court with any precedent for its narrow reading of the applicable case law and directly contradicted the policy underlying that case, which held that “the law favors compromise and a compromising party ought to be able to buy his peace with finality.”
