Partner Bruce Kraus’ Yale Journal of Regulation was noted in an article by The Wall Street Journal’s MarketWatch titled “The court where securities rules go to die.” The article discussed how in recent years the U.S. Court of Appeals for the D.C. Circuit has denied challenges to Dodd-Frank and SEC rules. Security regulators have failed to win any challenges and believe that appealing or litigating will lead to similar outcomes. Mr. Kraus’ study was cited stating that a series of D.C. Circuit decisions invalidating SEC rules “has cast the agency’s rule-making authority in doubt.”
