In an article, "Antitrust Lawyers Wary of Yahoo! Deal," The Daily Deal and TheDeal.com quoted partner Richard E. Donovan on the improbable merger of Yahoo! Inc. with either Microsoft Corp. or Google Inc.
The article quoted Mr. Donovan as follows: "'Antitrust law prohibits mergers that would substantially harm competition, and since Google, Yahoo! and Microsoft are so large and competing on so many fronts, it would be 'surprising' for a merger to get antitrust approval from the Justice Department,' said Richard Donovan, a partner at Kelley Drye & Warren LLP in New York.
'Any merger proposal now would be especially surprising, given that a presidential election is two weeks away and will result in the change of enforcement officials at the top of the DOJ's antitrust division,' Donovan noted. 'A new administration – whoever is elected – isn't going to be more lenient,' Donovan said."
