Partner Richard E. Donovan was quoted in The Daily Deal article, "FTC Victory Offers Road Map for Future Challenges."
The article examined U.S. District Court Judge Rosemary Collyer's decision that allowed the Federal Trade Commission to block a $1.4 billion merger between CCC Information Services, Inc. and Mitchell International Inc. The companies are two of three of the country's auto collision repair estimation software producers.
The article noted that the decision may give FTC lawyers more power than the DOJ antitrust division, in preventing mergers.
"‘That difference could mean that in the future, the FTC may be more willing to challenge a merger than the DOJ might be, because the FTC is more likely to win with a lower standard,’ said Richard Donovan, a partner at Kelley Drye & Warren LLP. ‘Clients with mergers that could be reviewed by either agency might well perceive that they would have a slight advantage if the DOJ evaluates the deal,’ he said."
