Mr. Mon reviewed the recent class action suit, In re Groupon Marketing and Sales Practices Litigation, where plaintiffs sued Groupon in the Southern District of California, claiming that Groupon’s vouchers should be considered gift cards. Although paid amounts of Groupon vouchers do not expire, promotional values do expire, violating gift card expiration restrictions. Mr. Mon noted that this settlement underscores the confusing interplay of federal laws and state laws regulating gift cards and provides a list of steps that companies can take to minimize the risk of being targeted in similar lawsuits.
