Portal Healthcare Solutions LLC.
The Fourth Circuit ruled that Travelers was bound to defend Portal Healthcare in a class action alleging that it failed to secure a server containing confidential patient records, leaving the records available to view online without a password. The holding was an important victory for policyholders, showing that there can be coverage under a CGL policy for publication of confidential personal information, depending on policy language.
