Partner Andrew M. White was mentioned in the Law360 article “Samsung JV Can't Stop Release Of LA Subway Contract Bid.” The article reports on a ruling by a California judge denying the request of joint venture Westside Transit Partners to block the disclosure of its passed-over bid on a multimillion-dollar contract to build Los Angeles’ Westside subway extension despite its trade secret concerns. The contract has been recommended to go to joint venture Skanska-Traylor-Shea, who filed its own suit against the Metro seeking to block the release of its bid, also citing trade secrets concerns.
The article notes that Kelley Drye client Dragados Astaldi Southland, a joint venture that had also competed for the bid, intervened in both cases last month to support the release of the bids, claiming in its complaint in intervention that its bid was by far the lowest priced, and that allowing the release of the bids will allow the public to see why the Metro went with the more expensive option. Mr. White represents Dragados Astaldi Southland in this matter.
