In the article, "Thermos Prevails in Asbestos Suit Coverage Fight," Law360 reported that an Illinois federal judge ruled Safety National Casualty Company must pay TKK USA (f/k/a The Thermos Company) defense costs for a lawsuit alleging asbestos exposure. The article noted that Safety National argued its policy only covered claims filed under workers' compensation or employers' liability laws of Illinois. The article stated Thermos persuaded the judge that negligence claims were covered. Judge James Zagel ruled that under Illinois law an insurer must pay defense costs for the entire suit even if only one of the theories of recovery allegedly in the underlying complaint is potentially covered by the policy.
